CMS Releases CY 2023 Medicare Physician Fee Schedule Final Rule
On November 1, the Center for Medicare & Medicaid Services (CMS) released the calendar year (CY) 2023 Medicare Physician Fee Schedule Final Rule. The text is available here. CMS also released a fact sheet on the final rule. ACNS has posted a summary of the final rule here.

Election Update and Lame-Duck Session Outlook
Last weekend, it was announced that Democrats won the closely contested Senate elections in Arizona and Nevada, ensuring they will maintain control of the chamber in the 118th Congress. There is still one Senate race outstanding in Georgia, and final election results will not be known until after the runoff election on December 6.

Update on Prior Authorization Legislation
The Senate bill sponsors hope to include the Improving Seniors’ Timely Access to Care Act (S. 2018/H.R. 3173) in an end-of-year legislative package, and the bill now has almost 60 co-sponsors in the Senate.

Public Health Emergency Likely to be Extended
Department of Health and Human Services Secretary Xavier Becerra had promised to give stakeholders a 60-day notice before the end of the public health emergency. If the public health emergency were to end on January 11, 2023, when the most recent extension expires, that notice would have been provided on November 12.
